Terms of Use Agreement

Welcome to Magicsnap! This Terms of Use Agreement (“Agreement”) governs your access and use of our website, magicsnap.ai (“Site”), and our mobile applications (collectively, the “App” and together with the Site, the “Services”). The Services are provided by Base Technology Co, Ltd., its beneficiaries, and affiliates (“Magicsnap,” “we,” or “us”). By accessing, browsing, or using the Site, App, or any aspect of our Services, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to this Agreement (including the arbitration provision and class action waiver in Section 13A if you are in the United States), please do not use our Services.
Eligibility
To use our Services, you must be at least 13 years old. In some cases, the age requirement may be higher due to local regulations or Distribution Channels. The Services are not intended for users under 13 years of age. If you are under 18 (or the legal age of majority where you live), but over 13 years old, you may only use our Services with parental or legal guardian consent. Parents or legal guardians are responsible for the actions of users under 18 accessing our Services. If you use our Services on behalf of someone else, you must have the authority to accept this Agreement on their behalf, and they agree to be bound by it.

User Content
You may create and share content, including photos, and other materials (collectively, “User Content”), through our Services. You retain ownership of your User Content, but by using our Services, you grant us a license to use, modify, distribute, and display your User Content for the purpose of providing the Services.
Some Services may display sponsored advertisements and promotions, and you agree that we may place such content on our Services. Sponsored content may not always be identified as such.
You are responsible for the User Content you upload or share and must have the necessary rights to do so. Do not use the Services for illegal or unauthorized purposes, and do not upload content that violates this Agreement.
Prohibited Conduct and Content
When using our Services, do not engage in harassing, illegal, or harmful activities. Do not attempt to interfere with the functioning of the Services, reverse engineer the App, or use third-party applications without our consent. You may not upload or share content that is unlawful, defamatory, obscene, infringing on intellectual property rights, or harmful to others.
Limited License; Copyright and Trademark
You are granted a limited, non-exclusive license to use our Services for personal use only. Do not use our Services for commercial purposes or on behalf of a legal entity. TheMagicsnap Content, including trademarks, is owned or licensed by us and protected by intellectual property laws. You may not use our trademarks or content without our written permission.
Feedback
If you provide feedback, suggestions, or ideas to us, they become our property, and we can use them without any obligations to you.
Copyright Complaints
If you believe that your copyright has been infringed, please follow our copyright complaint procedure.
Compensation
You agree to indemnify and defend Magicsnap and its affiliates against any claims, damages, or losses arising from your use of the Services or violation of this Agreement.
Disclaimers
Our Services are provided “as is” without warranties or conditions of any kind. We do not guarantee the accuracy, completeness, or security of the Services. Your use of the Services is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Magicsnap and its affiliates will not be liable for indirect, consequential, or special damages. Our total liability to you is limited to the amount paid for using our Services.
Release
To the fullest extent permitted by law, you release Magicsnap from any liability related to disputes between users or third parties.
